Terms of service
By creating a Cobbi account you accept these terms. Read them: two sections define responsibilities that are yours, and it is better that they do not take you by surprise.
1. What Cobbi is
Cobbi helps you collect what you are owed, by sending reminders over WhatsApp to your customers and reconciling payments when they send you the receipt. It includes the web dashboard, the email inbox for receiving invoices, file import, installment plans and reports.
Cobbi is a communication and receivables organisation tool.
2. What Cobbi is not
This matters as much as the previous section:
We are not a debt collection agency. We do not collect on your behalf, we do not negotiate with your customers and we do not manage the debt. We send the messages you schedule.
We do not calculate interest, late fees or surcharges. Never, not even in installment plans. This is a product decision: charging interest on a debt is lending, and lending is regulated. The amounts are the ones you record.
We do not give legal or financial advice. If a message cites a regulation, it is informational and does not replace a lawyer.
We do not report anyone. Cobbi does not send information to credit bureaus or any credit registry.
We do not guarantee you will get paid. A reminder properly sent is not a payment received.
3. Your account
Give accurate information and keep it current. Look after your access: any activity on your account is treated as yours. If you believe someone else got in, tell us immediately. If you open the account on behalf of a company, you declare that you can bind it.
4. The messages are your responsibility
This is the most important section in this document.
You are solely responsible for who you write to, the data you upload, and what your messages say. Specifically, you undertake to:
- Have a real commercial relationship with every person you charge, and a legitimate reason to hold their number.
- Comply with your country's data protection law and with Meta and WhatsApp policies, which apply to everything that leaves this platform.
- Record charges that exist. Using Cobbi to collect invented or third-party debts is grounds for immediate closure.
- Immediately respect anyone who asks to stop receiving messages. Cobbi blocks sending automatically when someone replies BAJA, but that does not entitle you to contact them by another channel against their wishes.
You may not use Cobbi for unsolicited messages, advertising, deception, threats, harassment, or anything unlawful.
If what you send results in a complaint, a penalty from Meta or a third-party claim, you answer for it.
5. Third-party services
Cobbi runs on the WhatsApp Business Platform, and uses Stripe, Amazon Web Services and artificial intelligence providers. Each has its own terms.
We do not control those platforms. In particular, we cannot guarantee that Meta will approve a template, that a message will be delivered, or that your number will keep its quality rating. If Meta limits or blocks a number, the service degrades for as long as that lasts, and it is not something we can fix for you.
6. Plans and billing
There is a free trial. When it ends, if you do not pick a plan, the account becomes read-only: you still see your receivables but no reminders go out.
Plans are billed in advance and renew automatically until you cancel. You can cancel whenever you want and the service continues until the end of the period already paid for.
Each plan includes a number of reminders per month. When you run out, sending pauses until the following month or until you upgrade; we warn you before you reach the limit. The messages we send to you do not consume your quota.
We refund the first payment if you ask within 30 days of starting to use the service. After that there are no refunds, unless the law says otherwise. Any applicable taxes are on you.
If a payment fails, we tell you before suspending anything.
7. Your data
The data you upload is yours. We process it to operate the service, in line with our privacy policy.
You can export your receivables whenever you want. If you close the account, we delete your data according to the deadlines in that policy.
8. Availability
We do what is reasonable to keep the service available, but there can be outages, delays and errors. A reminder may not go out on time for reasons outside our control: a Meta outage, a network problem, a blocked number.
Do not use Cobbi for urgent or critical communications. It is not a reliable channel for anything that cannot wait.
9. Acceptable use
In addition to section 4, you may not: attempt to breach the security of the service, reverse-engineer it, resell it without an agreement, automate it in ways that degrade it, or use it against the law or the rights of a third party.
We may suspend or close an account that breaches this. Where possible we warn first; if there is risk to the service, to other users, or to compliance with Meta's rules, we act first.
10. Intellectual property
The software, the brand and the content of Cobbi are ours. You have a limited, non-exclusive, non-transferable licence to use the service in your business while your account is current. That transfers no rights over the platform to you.
11. Warranties and liability
The service is provided as is. We do not warrant that it will run without interruption or error, that messages will be delivered or read, or that you will recover what you are owed.
We are not liable for indirect damages, lost profits, lost data or lost business opportunities. Our total liability is limited to what you have paid us in the 12 months before the event giving rise to it.
Some countries do not allow these exclusions. Where that is the case, they apply to the fullest extent the law permits.
12. Indemnity
If a third party makes a claim against us over the data you uploaded, the messages you sent, or your use of the service, you take on that claim and the costs it generates.
13. Changes and termination
We may change the service or these terms. If the change is material, we tell you before it takes effect. Continuing to use Cobbi after that date means you accept it.
You can stop using Cobbi whenever you want, from your dashboard.
The sections on payments, intellectual property, liability, indemnity and governing law survive the closure of your account.
14. Governing law
These terms are governed by the law of the domicile of the entity providing the service, and disputes are resolved before its courts.

If any clause turns out to be unenforceable, the rest remains in force. Write to us with any question about these terms.
